A public hearing of the Louisville Metro Air Pollution Control Board (Board) was called to order November 16, 2005, at 9:00 a.m. in the Board Room of the Louisville Metro Air Pollution Control District, 850 Barret Avenue, Louisville, Kentucky, by the Vice-Chairman, Lee Howard.
The chairman read the opening announcement, rules, and purpose of the hearing of the Louisville Metro Air Pollution Control Board, which was to review one proposed amended regulation.
Art Williams, Director, Air Pollution Control District (District), said that written comments were submitted by Greater Louisville, Inc., Noveon, Brown-Forman, and Doug Spillman. He said that the District will not recommend that the Board take action on this regulation at today’s Board meeting.

Ms. Embry asked why companies that are not Group 1 or 2 stationary sources but emit some regulated toxic air contaminants (TACs) are not included in the proposed regulation to pay a Strategic Toxic Air Contaminant (STAR) Program fee.
Mr. Williams responded that as the District develops more detailed information on the TAC emissions and resulting risk from minor and area sources pursuant to Regulation 5.30, the District may recommend future STAR Program fees for minor and area sources. For Fiscal Year 2006, the work on minor and area sources is being paid for by carry-over funds from the Vehicle Emissions Testing (VET) Program.
Board member Carolyn Embry asked why the proposed STAR Program fees are significantly increased from the STAR Program fees that were originally proposed with the other STAR Program regulations.
Mr. Williams explained that there were only five STAR Program positions approved for Fiscal Year 2005, therefore, there was a smaller STAR Program fee originally proposed. For Fiscal Year 2006, there are an additional six STAR Program positions, therefore the current proposed fee is larger. Because the VET Program surplus is limited, funding for part of the STAR Program for future years will be need to be addressed for the next fiscal year. The Louisville Metro government’s budget process for Fiscal
Year 2007 starts in January. Approval for the use of general funds for part of the STAR Program is granted through the budget process, which generally is completed in June. The Board has the authority to require program fees to be paid by minor and area sources.Ms. Smith asked the District to report to the Board on the TAC emissions from the minor and area sources. Mr. Williams responded that the District will provide this information to the Board at a future meeting.
