Louisville Metro Air Pollution Control Board

January 19, 2005

A public hearing of the Louisville Metro Air Pollution Control Board (Board) was called to order January 19, 2005, at 9:05 a.m.. in the Board Room of the Louisville Metro Air Pollution Control District, 850 Barret Avenue, Louisville, Kentucky, by Vice-Chairman Lee Howard.

General Statement, Rules, and Purpose

Vice-Chairman Howard read the opening announcement, rules, and purpose of the Public Hearing, which was to review one Agreed Board Order.

1. Agreed Board Order with Cardinal Aluminum Company

Terri Phelps explained that the proposed Agreed Board Order (ABO) (PDF) alleges that Cardinal Aluminum Company (Company) violated its operating permit and Regulation 6.09 and requires the Company to pay an administrative penalty. The Company has agreed to the terms of the ABO.

Ms. Phelps said that in May 2001 the District began receiving complaints of a visible plume of nitrogen oxide fumes being emitted by the Cardinal Aluminum facility on Preston Highway. The District documented these visible NOx emissions on six days between May and August 2001. Since that time, the Company has developed and implemented procedures and has installed monitoring equipment to correct the problem. The District has conducted surveillance in the area since the corrective measures were taken and has confirmed that emissions are no longer visible. No further complaint has been received. The ABO provides for an administrative penalty of $6,750, which the Company has paid.
