of the
Louisville Metro Air Pollution Control Board

September 17, 2003

A public hearing of the Louisville Metro Air Pollution Control Board was called to order September 17, 2003, at 9:03 a.m. in the Board Room of the Louisville Metro Air Pollution Control District, 850 Barret Avenue, Louisville, Kentucky, by Board Member Lee Howard.

General Statement, Rules, and Purpose

Mr. Howard read the opening announcement, rules, and the purpose of the hearing, which was to review one Agreed Board Order.

1. Agreed Board Order with Metropolitan Sewer District

Ms. Phelps explained that the proposed Agreed Board Order (ABO) for the Metropolitan Sewer District (MSD) would extend the deadline, established in the September 20, 2000, ABO, to complete the Alternative Solids Project at the Morris Forman Wastewater Treatment Plant (MFWTP) and to discontinue the use of the Zimpro solids handling system. Additionally, the Louisville Metro Air Pollution Control District (District) has alleged that odors from the MFWTP violated District regulations and the proposed ABO would require MSD to implement a supplemental environmental project. The MSD has agreed to the terms of the proposed ABO.

In January 2002, MSD notified the District that installation of the Alternative Solids Processing System would not be completed by the February 5, 2003, deadline and requested an extension. The District proposes an extension until December 1, 2003. With regards to the alleged odor violations, the District determined that either the objectionable odors were not related to the construction project or, if the odors were construction related, MSD did not take reasonable measures to mitigate the odors. The 2000 ABO had included a provision that the District would not take enforcement action against MSD for objectionable odors during the construction project, as long as the odors were construction related and MSD took reasonable efforts to minimize the odors. Today’s proposed ABO does not include the enforcement limitation for construction-related odors. The MSD has agreed to conduct a supplemental environmental project requiring MSD to spend up to $10,000 to purchase equipment and provide odor training to aide the District in the detection, and identification of the source, of objectionable odors.

Statements

Marsha Jenkins, Assistant Legal Council for MSD, said that MSD appreciated the opportunity to enter into this supplemental environmental project. She said that it is hoped that the additional training and equipment will benefit the District.
