A public hearing of the Louisville Metro Air Pollution Control Board was called to order April, 16, 2003, at 9:02 a.m. in the Board Room of the Louisville Metro Air Pollution Control District, 850 Barret Avenue, Louisville, Kentucky, by Acting Chair, Karen Cassidy.
The Chair read the opening announcement, rules, and purpose of the hearing, which was to review one proposed amended regulation.
Mr. Trout explained that Regulation 6.43 was part of the industry 15% plan that was required by the 1990 Clean Air Act Amendments. The proposed amendments do not change any substantive requirements. The proposal would provide the option for American Synthetic Rubber Company LLC to use the new regenerative thermal oxidizer instead of one or both of the two existing coal-fired boilers to control the volatile organic compound emissions from the processes in the finishing building. Additionally, company name changes in Section 8 (now Marathon Ashland Petroleum LLC, Aetna Terminal), Section 9 (now Carbide Industries LLC), Section 10 (now PPG Architectural Finishes), and Section 15 (now Marathon Ashland Petroleum LLC, Kramers Lane) would be made to reflect the current company names for these stationary sources; the District’s emission inventory system number for DuPont Dow Elastomers L.L.C. in Section 11 would be changed to the current number; and Section 12 (The Earthgrains Company) and Section 16 (Philip Morris Incorporated, Maple Street Plant) would be removed because these stationary sources are no longer in operation.
Mr. Trout said that during the written comment period there were two comments received. The Kentucky Division for Air Quality (DAQ) indicated that where applicable, the provisions of this regulation are at least as stringent as the corresponding state regulations and prior concurrence is granted. The U.S. Environmental Protection Agency, Region 4 (EPA) had no comment on the proposed changes.
Mr. Trout said that the District intends to recommend that the Board, at today’s Board meeting, adopt amended Regulation 6.43 Volatile Organic Compound Emission Reduction Requirements, Version #4, Draft #3 - Proposed, February 12, 2003, as proposed, pending evaluation of any comments made at today’s Public Hearing.
