A public hearing of the Air Pollution Control Board of Jefferson County was called to order January 15, 2003, at 9:03 a.m. in the Board Room of the Air Pollution Control District, 850 Barret Avenue, Louisville, Kentucky, by the Chairman, Joseph Vibbert.
The Chairman read the opening announcement, rules, and purpose of the hearing, which was to review the proposed amendment to one regulation.
Mr. Trout explained that Regulation 5.02 incorporates the federal regulations that apply to hazardous air pollutants, 40 CFR Part 61, the National Emission Standards for Hazardous Air Pollutants (NESHAP) regulations, and 40 CFR Part 63, the maximum achievable control technology (MACT) regulations. The District enforces the current federal regulations, and, through its grant agreements with the U.S. Environmental Protection Agency (EPA), is required to update its regulations to be able to enforce these federal regulations. The District periodically updates Regulation 5.02 by including citations to Federal Register notices that add new Part 61 or Part 63 regulations or modify existing Part 61 or Part 63 regulations.
Mr. Trout said that the EPA has made two more changes to the existing Part 63 regulations since December 6, 2002. The District will request, at today’s meeting, that the Board consider adopting these changes along with the other changes that were proposed. The newest changes are the December 19th Federal Register notice (67 FR 77687) to be included on page 7, Subpart EEE, National Emission Standards for Hazardous Air Pollutants from Hazardous Waste Combustors, and the December 30th Federal Register notice (67 FR 79808) to be included on page 8, Subpart RRR, National Emission Standards for Hazardous Air Pollutants for Secondary Aluminum Production.
Mr. Trout indicated that no comment was received during the 30-day written public comment period.
Mr. Trout said that the District intends to recommend that the Board, at today’s Board meeting, adopt amended Regulation 5.02 Adoption of Federal Emission Standards for Hazardous Air Pollutants, Version #12, Draft #2 - Proposed, December 6, 2002, as proposed except for the inclusion of the two additional Federal Register notices that he identified, pending evaluation of any comments made at today’s Public Hearing.
