Air Pollution Control Board of Jefferson County

November 20, 2002

A public hearing of the Air Pollution Control Board of Jefferson County was called to order November 20, 2002, at 9:00 a.m. in the Board Room of the Air Pollution Control District, 850 Barret Avenue, Louisville, Kentucky, by the Chairman, Joseph Vibbert.

General Statement, Rules, and Purpose

The Chairman read the opening announcement, rules, and purpose of the hearing, which was to review the proposed amendment to one regulation.

1. Amendment to Regulation 6.29 Standard of Performance for Graphic Arts Facilities Using Rotogravure or Flexographic Printing, Version #8, Draft #1 - Proposed, October 9, 2002.

Mr. Trout explained that at the September 26, 2002, meeting the Board adopted changes to Regulation 6.29, including the consolidation of Regulation 7.57, for new Graphic Arts Facilities, into Regulation 6.29. A comment sent by the Kentucky Small Business Stationary Source Compliance Advisory Panel (SBSSCAP) via FAX to the District during the written comment period was not acknowledged pursuant to the comment period; therefore, the suggested change, with which the District agreed, was not addressed. The comment made by the SBSSCAP was that the language in section 6.1.3 did not provide guidance on what would constitute an acceptable plan for prorating emissions to the appropriate compliance averaging period and that there was no certainty that the District would approve a plan even if it were technically acceptable. The current proposed amendment would modify the language of section 6.1.3 as suggested by the SBSSCAP.

Mr. Trout said that during the written comment period the U.S. Environmental Protection Agency, Region 4 (EPA) suggested that the District would want to have the discretion to not approve extending the recordkeeping period even though the company submitted an acceptable method. The District disagrees with the comment. If a company submits a plan that is technically acceptable and it could be written in a way that is practically enforceable, then the District should approve the plan. Mr. Trout reiterated that the District believes that there would be no loss of environmental protection from the approval of an acceptable, enforceable plan to extend the recordkeeping period.

Mr. Trout said that the District intends to recommend that the Board adopt amended Regulation 6.29 Version #8, Draft #1 - Proposed, October 9, 2002, at the Board meeting today, pending evaluation of any comments made at the Public Hearing.
