A public hearing of the Air Pollution Control Board of Jefferson County was called to order August 21, 2002, at 9:00 a.m. in the Board Room of the Air Pollution Control District, 850 Barret Avenue, Louisville, Kentucky, by the Chairman, Joseph Vibbert.
The Chairman read the opening announcement, rules, and purpose of the hearing, which was to review two proposed amended regulations and one proposed repealed regulation.
Mr. Trout explained that the main purpose of the proposed amendment to Regulation 6.29 is to allow ink and coating usage records to reflect a longer period of time than the current daily requirement. The inks and coatings used during this longer time period would then be prorated to the appropriate compliance period based upon some other measured parameter, such as linear feet of substrate printed. This change would not reduce the environmental benefit of the regulation, but would allow companies to make recordkeeping requirements easier.
A provision is being added to approve a longer, up to one month, than daily compliance averaging time, although any longer averaging time extension would require the approval of the U.S. Environmental Protection Agency (EPA). Additionally, the ink and coating volatile organic compound (VOC) content specifications are being recognized as limits rather than exemptions to the compliance requirements. Further, Regulation 7.57 would be repealed and Regulation 6.29 would apply to all rotogravure and flexographic printing lines, regardless of the date of installation. Finally, numerous non-substantive changes are made to be consistent with the language used in the current regulations.
Mr. Trout said that during the public comment period the Kentucky Division for Air Quality (DAQ) indicated that the proposed changes were acceptable. The DAQ granted prior concurrence for amended Regulation 6.29 and the repeal of Regulation 7.57. Mr. Trout also said that during the informal comment review period, the EPA Region 4 indicated that the agency had no comment on the regulations.
Mr. Trout said that the District intends to recommend that the Board approve amended Regulation 6.29 Version #7, Draft #1 - Proposed, May 29, 2002, as proposed, and the repeal of Regulation 7.57 at today=s meeting, pending evaluation of any comments made at the Public Hearing.

Mr. Trout explained that the purpose of the proposed amendment to Regulation 5.14 is to add a new section that lists area sources of hazardous air pollutants (HAPs). Pursuant to '112(c)(3) and '112(k)(3)(B)(ii) of the Clean Air Act, the EPA is required to identify and list area source categories representing at least 90 percent of the emissions of the 30 Alisted@ area source HAPs. These area source categories are, or will likely be, subject to standards under ' 112(d) of the Clean Air Act.
Mr. Trout said that during the public comment period the DAQ indicated agreement with the proposed addition to this regulation and granted prior concurrence.
Mr. Trout said that the District intends to recommend that the Board approve amended Regulation 5.14 Version #6, Draft #2 - Proposed, July 17, 2002, as proposed, at today=s meeting, pending evaluation of any comments made at the Public Hearing.
