Regular Meeting
of the
Air Pollution Control Board of Jefferson County
July 18, 2001
The regular meeting of the Air Pollution Control Board of Jefferson County was called to order July 18, 2001, at 9:09 a.m. in the Board Room of the Air Pollution Control District, 850 Barret Avenue, Louisville, Kentucky, by the Chairman, Dr. Robert Powell. Joe Vibbert, Lewis Hammond, Lee Howard, and Michael Hesse were present. A quorum was present.
The following staff were present: Art Williams, Jon Trout, Gayle Ballard, Cynthia Lee, Doug Spillman, Martha Gammons, Bruce Gaylord, Terri Phelps, Rebecca Stutsman, Tom Pinto, Barry Zalph, Phyllis Fitzgerald, and Helen Harman. Kathy Matheny, Director of Government Affairs for the Judge/Executive’s Office, was also present.
The following guests were present: Jonathan Miller, DuPont Dow Elastomers; Brad Dillon, Greenebaum Doll & McDonald; Malcolm Winsper and David Newman, Kentucky Motorcycle; Dick Everhart, Smith Management Group; Deb Porter, Gordon-Darby; Marlene Zeckner Pardee, LG&E; Mark Spaulding, SportPaint; Carolyn Embry, American Lung Association; Steve Marks, GE; and Martin Luther, KY Division for Air Quality.Mr. Trout introduced Claudette Davis, a temporary worker from the Senior Community Service Employment Program of AARP. Mr. Trout also recognized that Amie Bonner, who works in the afternoon, is a second temporary worker from the Program.
Approval of Minutes
Mr. Trout suggested two corrections to the minutes. One correction was in the Public Hearing minutes with a date of October 17, 2001, that should be October 17, 2000. The other correction was in the Board Meeting minutes under New Business Paragraph C; Joe Vibbert was spelled with a small v and it should be a capital V. The minutes of the Public Hearing and Board meeting of May 16, 2001, were approved as corrected.
Unfinished Business
Election of Chairman and Vice Chairman
Dr. Powell and Mr. Vibbert were elected Chairman and Vice-Chairman, respectively, by unanimous consent.
Air Quality Trust Fund Report
Mr. Trout said that $20,000 was deposited into the interest-bearing Air Quality Trust Fund account as a result of a court settlement with Evans Development Corporation. The ending balance of $24,692.06 is for FY 2001. A copy of the Annual Accounting Report is attached to the original minutes.
Committee Reports
A. Policy Committee
The Policy Committee has not met but is scheduled to meet Thursday, August 2, at 9 a.m. to review an amendment to Regulation 2.08.
B. Strategy Committee
The Strategy Committee has not met.
Staff Reports
A. Director
Mr. Williams asked Mr. Trout to report on the redesignation request. Mr. Trout said that on June 21, 2001, the U.S. Environmental Protection Agency (EPA) published a notice in the Federal Register proposing to approve into the Kentucky State Implementation Plan (SIP) the current version of nearly every District regulation. On June 22, 2001, the EPA published a notice in the Federal Register proposing to approve Kentucky’s and Indiana’s requests to redesignate the Louisville area to attainment for the 1-hour ozone national ambient air quality standard. In the near future, the EPA will also publish a notice in the Federal Register proposing to approve Regulation 6.49, the “SOCMI CTG” regulation, into the Kentucky SIP and a notice giving final approval of the regulations that were included in Jefferson County’s 15% volatile organic compound (VOC) reduction plan.
Mr. Williams said that there has not been an exceedance of the 1-hour ozone standard during 2001 to date. There have been ten exceedances reported on six different days of the 8-hour ozone standard, with the most recent exceedance occurring Monday.
Mr. Williams discussed the June 2001 PM2.5 monthly average and year-to-date annual average summary. A copy is attached to the original minutes. The monitored PM2.5 concentrations for the month of June averaged 20.5 µg/m3. The annual PM2.5 standard is 15.0 µg/m3. During the past 30 months, the average of the Jefferson County PM2.5 monitors was 17.2 µg/m3.
Mr. Williams distributed a copy of the 2000 Annual Report for Vehicle Emissions Testing. Mr. Vibbert commended the staff on an excellent report.
Mr. Williams said that the Reverend Louis Coleman had filed a civil complaint with EPA concerning the two-minute speaking time he was given by the Board. The EPA rejected Reverend Coleman’s complaint saying that the complaint failed to state any act of discrimination.
Mr. Williams said that the National Academy of Science will release a report tomorrow examining the effectiveness of Inspection and Maintenance (I/M) Programs throughout the country.B. VET

C. Enforcement Status
The Enforcement Status Report dated July 10, 2001, was submitted for filing. A copy is attached to the original minutes.
