Regular Meeting
of the
Air Pollution Control Board of Jefferson County

June 20, 2001

 

The regular meeting of the Air Pollution Control Board of Jefferson County was called to order June 20, 2001, at 9:18 a.m. in the Board Room of the Air Pollution Control District, 850 Barret Avenue, Louisville, Kentucky, by the Chairman Dr. Robert Powell. Joe Vibbert, Lewis Hammond, Karen Cassidy, Lee Howard, and Michael Hesse were present. A quorum was present.

The following staff were present: Art Williams, Jon Trout, Jess Goldsmith, Gayle Ballard, Cynthia Lee, Art Chang, Doug Spillman, Martha Gammons, Bruce Gaylord, Chris Bryant, Terri Phelps, Rebecca Stutsman, Tom Pinto, Keith Earle, Bob Dorzback, Phyllis Fitzgerald, and Helen Harman. Kathy Matheny, Director of Government Affairs for the Judge/Executive’s Office, was also present.

The following guests were present: Carl Hilton, E.I. Mr. Williams introduced Robert Dorzback, Air Pollution Technical Coordinator for the District’s pollution prevention program.

Approval of Minutes

The minutes of the Public Hearing and Board meeting of May 16, 2001, were approved.

New Business

A. Amendment to Regulation 1.15 Version of Federal Regulations Incorporated by Reference

The District recommended that the Board adopt the amendment to Regulation 1.15 identified as Version #8, Draft #2 - Proposed, April 4, 2001. This is the version that underwent the public review process.

ACTION: Mr. Vibbert moved the adoption of the amendment to Regulation 1.15 identified as Version #8, Draft #2 - Proposed, April 4, 2001.

The motion passed unanimously.

 

B. Amendment to Regulation 5.02 Federal Emission Standards for Hazardous Air Pollutants Incorporated by Reference

The District recommended that the Board adopt the amendment to Regulation 5.02 identified as Version #9, Draft #7 - Proposed, Revision 1, June 15, 2001. This version includes the changes identified at the Public Hearing to Version #9, Draft #6 - Proposed, May 1, 2001, the version that underwent the public review process.

ACTION: Mr. Howard moved the adoption of the amendment to Regulation 5.02 identified as Version #9, Draft #7 - Proposed, Revision 1, June 15, 2001, as presented today.

The motion passed unanimously.

C. Amendment to Regulation 7.02 Federal New Source Performance Standards Incorporated by Reference

The District recommended that the Board adopt the amendment to Regulation 7.02 identified as Version #8, Draft #6 - Proposed, Revision 1, June 18, 2001. This version includes the changes identified at the Public Hearing to Version #8, Draft #5 - Proposed, May 1, 2001, the version that underwent the public review process.

ACTION: Mr. Vibbert moved the adoption of the amendment to Regulation 7.02 identified as Version #8, Draft #6 - Proposed, Revision 1, June 18, 2001, as presented today.

The motion passed unanimously.

D. Amendment to Regulation 5.14 Hazardous Air Pollutants and Source Categories

The District recommended that the Board adopt the amendment to Regulation 5.14 identified as Version #4, Draft #3 - Proposed, April 26, 2001. This is the version that underwent the public review process.

ACTION: Mr. Hesse moved the adoption of the amendment to Regulation 5.14 identified as Version #4, Draft #3 - Proposed, April 26, 2001.

The motion passed unanimously.

E. Amendment to Regulation 5.15 Chemical Accident Prevention Provisions

The District recommended that the Board adopt the amendment to Regulation 5.15 identified as Version #3, Draft #3 - Proposed, April 26, 2001. This is the version that underwent the public review process.

ACTION: Mr. Howard moved the adoption of the amendment to Regulation 5.15 identified as Version #3, Draft #3 - Proposed, April 26, 2001.

The motion passed unanimously.

F. New Regulation 6.49 Standards of Performance for Reactor Processes and Distillation Operations Processes in the Synthetic Organic Chemical Manufacturing Industry

The District recommended that the Board adopt new Regulation 6.49, identified as Version #1, Draft #2 - Proposed, April 27, 2001. This is the version that underwent the public review process.

ACTION: Ms. Cassidy moved the adoption of new Regulation 6.49, identified as Version #1, Draft #2 - Proposed, April 27, 2001.

The motion passed unanimously.

SIP Advisory Panel Report - met June 12, 2001

Mr. Moran said that the SIP Advisory Panel met on Tuesday, June 12, and received updated reports on 1-hour and 8-hour ozone and PM2.5 ambient monitored levels and discussed the 1-hour ozone redesignation request. The SIP Advisory Panel also received status reports on the activities of the Kentuckiana Ozone Prevention Coalition (KOPC), Congestion Mitigation and Air Quality Improvement Program (CMAQ) projects, Cornerstone 2020 code development, and the District’s no-mow program.

Committee Reports

A. Policy Committee

The Policy Committee has not met.

B. Strategy Committee

The Strategy Committee has not met

C. Nominating Committee

Mr. Hammond, as Chairman of the Nominating Committee, submitted the following report: for Chairman, Dr. Robert Powell, and for Vice Chairman, Mr. Joe Vibbert. The Board will elect officers at the July meeting. Nominations will remain open until the election.

Staff Reports

A. Director

Mr. Williams said that the redesignation request should appear in the Federal Register as a proposed approval within the next few weeks and a 30-day public comment will then begin.

Mr. Williams said that there has not been any exceedance of the 1-hour ozone standard during 2001 to date. There have been nine exceedances reported on five different days of the 8-hour ozone standard, with the most recent exceedance being reported yesterday. There have been four Ozone Action Days called.

Mr. Williams discussed the May 2001 PM2.5 monthly average and year-to-date annual average summary. A copy is attached to the original minutes. The monitored PM2.5 concentrations for the month of May averaged 17.7 µg/m3. The annual PM2.5 standard is 15.0 µg/m3. During the past 29 months, the average of the Jefferson County PM2.5 monitors was 17.1 µg/m3 .

The Chairman said that there was a recent study of increased heart attacks associated with high levels of PM2.5 in the Boston, Massachusetts area.

Mr. Williams said that the Vehicle Emissions Test (VET) program will begin implementing the full onboard diagnostic (OBD) testing program in January 2002. The VET program will soon begin trial OBD testing; this trial testing is expected to last for several weeks. In this phase of OBD program implementation, the drivers of 1996 and newer vehicles who are having their normal VET test will be asked to volunteer to also have their vehicles tested using the OBD equipment.

B. VET

The VET Report for May 2001 was submitted for filing. A copy is attached to the original minutes.

C. Enforcement Status

The Enforcement Status Report dated June 6, 2001, was submitted for filing. A copy is attached to the original minutes.
