Regular Meeting

Air Pollution Control Board of Jefferson County
May 16, 2001
The regular meeting of the Air Pollution Control Board of Jefferson County was called to order May 16, 2001, at 9:40 a.m. in the Board Room of the Air Pollution Control District, 850 Barret Avenue, Louisville, Kentucky, by the Chairman Dr. Robert Powell. Joe Vibbert, Lewis Hammond, and Michael Hesse were present. A quorum was present.
The following staff were present: Art Williams, Jon Trout, Gayle Ballard, Art Chang, Doug Spillman, Diane Hazellief, Gary Flispart, Martha Gammons, Bruce Gaylord, Chris Bryant, Terri Phelps, Barry Zalph, Deborah Donaldson, Phyllis Fitzgerald, Mitzi Powell, and Helen Harman. Kathy Matheny, Director of Government Affairs for the Judge/Executive’s Office, was also present.

Approval of Minutes
The minutes of the Board meeting of April 18, 2001, were approved.
New Business
Appoint Nominating Committee
The Chairman appointed Lewis Hammond as chairman of the Nominating Committee with Karen Cassidy and Joe Vibbert as members. The Committee will report at the June meeting and a vote will take place in July.
Committee Reports
A. Policy Committee
Mr. Hammond said that the Policy Committee met Tuesday, May 1 at 9:00 a.m. to discuss Regulation 6.49 Standards of Performance for Reactor Processes and Distillation Operations Processes in the Synthetic Organic Chemical Manufacturing Industry. The Policy Committee voted to proceed with the Public Review Process. The public comment period ends Friday, June 8 and the public hearing will be held before the June 20 Board Meeting.
B. Strategy Committee
Mr. Vibbert said that the Strategy Committee met Wednesday, May 2 at 9:00 a.m. to discuss
Regulations 1.15 Version of Federal Regulations Incorporated by Reference, 5.02 Federal Emission Standards for Hazardous Air Pollutants Incorporated by Reference, 7.02 Federal New Source Performance Standards Incorporated by Reference, 5.14 Hazardous Air Pollutants and Source Categories, and 5.15 Chemical Accident Prevention Provisions. The Strategy Committee voted to proceed with the Public Review Process on all five regulations. The public comment period ends Friday, June 8 and the public hearing will be held before the June 20 Board Meeting.
Staff Reports
A. Director
Mr. Williams informed the Board that Cara Waddell passed away. He announced the births for District staff families; Rebecca Stutsman had a son and Tom Hall’s wife had a son.
Mr. Williams briefly discussed and distributed a copy of the Metro Louisville MSA 8-Hour Ozone Attainment Report. There have been a total of five exceedances reported this year and they include: Charlestown, Bates, Watson, WLKY, Buckner, and Shepherdsville. The exceedances occurred on May 3 and May 5. There were 21 exceedances reported in 2000. This information will be reported to the Board monthly.
Mr. Williams discussed the April 2001 PM2.5 monthly average and year-to-date annual average summary. A copy is attached to the original minutes. The month of April averaged 13.3 µg/m3. The annual PM2.5 standard is 15.0 µg/m3. During the past 28 months, the average summary was 17.0 µg/m3 .
B. VET
The VET Report for April 2001 was submitted for filing. A copy is attached to the original minutes.
C. Enforcement Status
The revised and improved Enforcement Status Report dated May 4, 2001, was submitted for filing. A copy is attached to the original minutes.
