A public hearing of the Air Pollution Control Board of Jefferson County was called to order December 20, 2000, at 9:01 a.m. in the Board Room of the Air Pollution Control District, 850 Barret Avenue, Louisville, Kentucky, by the Chairman, Robert Powell, M.D.

General Statement, Rules, and Purpose

The Chairman read the opening announcement, rules, and purpose of the hearing which was to review an amendment to Regulation 2.08.

A. Amendment to Regulation 2.08 Emissions Fees, Permit Fees, Permit Renewal Procedures, and Additional Program Fees, Version #18, Draft #1-Proposed October 20, 2000

Mr. Trout said the purpose of the amendment to Regulation 2.08 is to correct a citation within the regulation that was not changed when this regulation was previously amended. The language regarding the consequences of failure to timely pay for certain permits and program fees is amended to clarify that a notice of violation for failure to timely pay relates to all permits and program fees. Additionally, if an asbestos permittee fails to timely pay for already-issued permits, upon notice by the District, payment of new permits is proposed to be required by cashier’s check rather than a regular check (or cash or money order). The District did not receive any written comments during the public comment period.

Mr. Vibbert asked about the Board imposing penalties. Mr. Trout replied that the District has a standard administrative procedure for notifying permitees that an issued permit has not been timely paid. If payment is not received by this grace period deadline, then a notice of violation is issued and a penalty is assessed.
